The NSW Department of Planning and Environment's Resources Regulator has commenced prosecution proceedings against Sibelco Australia Limited for alleged breaches of the Work Health and Safety Act 2011.
The prosecution is related to the serious injury of a worker at the Salt Ash Sand Plant, located approximately 20 kilometres north of Newcastle, on 1 February 2016.
The Resources Regulator will allege that Sibelco Australia Limited, part of the multinational Sibelco Group, breached sections 19 and 32 of the Work Health and Safety Act 2011 by failing to provide safe plant and equipment, a safe system of work and adequate supervision.
The maximum penalty for the alleged offence is $1,500,000.
The case is set down for first mention in the District Court of NSW on 12 March 2018.
As the matter is now before the Court, no further details will be released.
